INTRODUCCIÓN
“+Balance App x Belu Nutrition Coach” es una aplicación diseñada para proporcionar guías de nutrición, alimentación para pérdida de peso, cocina y hábitos saludables, que tiene como objetivo ayudar a los usuarios a mejorar su salud y bienestar.
Estos Términos de Uso se celebran entre usted como usuario (denominado “Usuario”, “usted” o “su”) y Belu Help Me Corp, ofreciendo servicios de asesoramiento en temas relacionados con alimentación y el estilo de vida saludable (denominados “Coaching Nutricional”).
En los siguientes términos y condiciones, el servicio será referido como el “Coaching Nutricional”. Al utilizar +Balance App x Belu Nutrition Coach, los usuarios aceptan los siguientes términos y condiciones. Si usted no acepta estos Términos de Uso, no debe acceder o usar la app.
El Usuario es la persona que recibe los servicios de Coaching Nutricional, y que busca mejorar su salud y bienestar a través del asesoramiento en temas relacionados con la alimentación y el estilo de vida. El Usuario reconoce que los servicios prestados no están destinados a suplantar el consejo médico profesional y que, a través del Coaching Nutricional, no se estará actuando en calidad de doctor, psicólogo u otro profesional registrado con especialidad médica.
El Usuario garantiza ser mayor de 18 años, siendo terminantemente prohibido acceder al mismo si usted no cuenta con la edad suficiente para brindar su consentimiento.
Belu Help Me Corp, así como sus creadores, profesionales independientes y cualquier otro dependiente de la primera, que de alguna manera esté involucrado en la elaboración del material disponible en +Balance App x Belu Nutrition Coach y el servicio de Coaching Nutricional, se deslindan de cualquier tipo de responsabilidad que se les pretenda atribuir, ya sea directa o indirectamente, en relación con cualquier decisión que el USUARIO tome al aceptar recomendaciones o sugerencias durante el uso del servicio, así como de cualquier efecto que puedan tener los productos y/o servicios aquí ofrecidos sobre el USUARIO. Cualquier uso de los materiales, recomendaciones o sugerencias proporcionados se hace bajo la entera responsabilidad del USUARIO, y en ningún caso se podrá atribuir responsabilidad alguna a Belu Help Me Corp, sus creadores, profesionales independientes o cualquier otro dependiente de la primera.
USO DE LA APLICACIÓN
El usuario acepta utilizar +Balance App x Belu Nutrition Coach únicamente para fines legales y autorizados. Se prohíbe el uso de la aplicación para cualquier propósito ilícito o que infrinja los derechos de terceros.
CONFIDENCIALIDAD
“+Balance App x Belu Nutrition Coach” garantiza que se mantendrá la información privada del Usuario y no compartirá información de este a un tercero a menos que la ley lo obligue. Solamente en el caso de que el Usuario esté de acuerdo y bajo previa aprobación, el Coach podrá compartir algún tipo de referencias de su progreso.
DESCARGO DE RESPONSABILIDAD
A través del Coaching Nutricional se brindará asesoramiento o recomendaciones sobre alimentación y patrones de hábitos, para ayudar a los usuarios a alcanzar sus metas, acompañándolos en el proceso de diseñar e implementar cambios positivos y sostenibles en su estilo de vida.
El Usuario entiende que el rol del Coaching Nutricional no es brindar atención medicinal, diagnosticar, tratar o curar cualquier enfermedad, afección u otra dolencia física o mental ni prescribir tratamiento médico.
Durante el Coaching Nutricional no se estará actuando en calidad de doctor, psicólogo u otro profesional registrado con especialidad médica. Cualquier recomendación dada no estará destinada a suplantar el consejo de estos profesionales. Si el Usuario está bajo el cuidado de un profesional de atención médica o actualmente usa medicamentos recetados, debe analizar cualquier cambio en la dieta o posibles suplementos dietéticos con su médico especialista y no deberá suspender ningún medicamento recetado sin consultar primero a su doctor.
RESPONSABILIDAD PERSONAL
El Usuario reconoce y asume toda la responsabilidad por su vida y bienestar, así como la vida y el bienestar de su familia, y asume la responsabilidad de todas las decisiones tomadas durante y después del uso de “+Balance App x Belu Nutrition Coach”. El Usuario asume expresamente los posibles riesgos de su uso, incluidos los riesgos de probar nuevos alimentos o suplementos, los riesgos inherentes a hacer ejercicio y de realizar cambios en su estilo de vida.
+Balance App x Belu Nutrition Coach no será responsable de ninguna pérdida o daño que resulte del uso de la aplicación, incluyendo daños indirectos, especiales, incidentales o consecuentes.
LIBERACIÓN DE RECLAMACIONES RELACIONADAS CON LA ATENCIÓN MÉDICA
El Usuario libera a Belu Help Me Corp de toda responsabilidad, daños, alegaciones, demandas, reclamos de sumas de dinero y exigencias derivadas del uso de “+Balance App x Belu Nutrition Coach”.
ARBITRAJE, ELECCIÓN DE LEY Y RECURSOS LIMITADOS
Todas las disputas que surjan de o en relación con el presente Acuerdo del Plan se resolverán finalmente de conformidad con las Reglas de Arbitraje de la Cámara de Comercio Internacional por uno o más árbitros nombrados de acuerdo con dichas Reglas.
MODIFICACIÓN DE LOS TÉRMINOS
Se informa al usuario que nos reservamos el derecho, en cualquier momento y a nuestro exclusivo criterio, de modificar los presentes Términos y Condiciones. En el caso de que se realicen modificaciones materiales a los Términos y Condiciones, se notificará al usuario mediante la publicación de una notificación en la aplicación o el envío de un correo electrónico. Se informa al usuario que el uso continuado de la aplicación después de que se hayan publicado las modificaciones a los Términos y Condiciones constituirá su aceptación de las mismas. Por consiguiente, se recomienda al usuario que revise periódicamente estos Términos y Condiciones para estar al tanto de las modificaciones que se puedan realizar.
En caso de que cualquier disposición de estos Términos y Condiciones se considere inválida o no aplicable por cualquier motivo, se informa al usuario que dicha disposición se considerará separable y no afectará la validez y aplicabilidad de las demás disposiciones.Asimismo, se informa al usuario que la renuncia a cualquier incumplimiento de estos Términos y Condiciones por nuestra parte no se interpretará como una renuncia a cualquier incumplimiento posterior.
PAGOS DE SERVICIOS Y REEMBOLSOS
Pago de Programas
La tarifa se abonará antes de la inscripción a cualquier programa. Los métodos de pago aceptados incluyen tarjeta de crédito, débito o a través de plataformas de pago en línea. Si el pago se realiza mediante transferencia bancaria, se debe proporcionar el comprobante de pago para confirmar la transacción. Una vez iniciado el servicio no se aplicarán reembolsos.
Pago de Productos Digitales

En caso de que los productos digitales (ebooks, clases grabadas u otra herramienta digital) experimente problemas técnicos que impidan su acceso, se proporcionará un reembolso completo al cliente si no se puede resolver el problema dentro de un período de 20 días.

TERMINACIÓN

The User acknowledges that the services provided are not intended to replace professional medical advice, and that through Nutritional Coaching, they will not be acting as a doctor, psychologist, or other medical specialty registered professional.
The User guarantees to be over 18 years of age, and it is strictly prohibited to access it if you are not old enough to give your consent.
Belu Help Me Corp, as well as its creators, independent professionals, and any other person associated with it, who in any way is involved in the elaboration of the material available in +Balance App x Belu Nutrition Coach and the Nutritional Coaching service, disclaim any kind of responsibility that may be attributed to them, either directly or indirectly, in relation to any decision that the USER may make when accepting recommendations or suggestions during the use of the service, as well as any effect that the products and/or services offered here may have on the USER. Any use of the materials, recommendations or suggestions provided is done under the full responsibility of the USER, and under no circumstances shall Belu Help Me Corp, its creators, independent professionals or any other person associated with it be held responsible.
USE OF THE APPLICATION
The user agrees to use “+Balance App x Belu Nutrition Coach” solely for legal and authorized purposes. The use of the application for any unlawful purpose or that infringes on the rights of third parties is prohibited.
CONFIDENTIALITY
“+Balance App x Belu Nutrition Coach” guarantees that the User’s information will be kept private and will not be shared with a third party unless required by law. Only with the User’s agreement and prior approval, the Coach may share some references to their progress.
DISCLAIMER
Through Nutritional Coaching, advice or recommendations on food and habit patterns will be provided to help users achieve their goals, accompanying them in the process of designing and implementing positive and sustainable changes in their lifestyle. The User understands that the role of Nutritional Coaching is not to provide medical attention, diagnose, treat, or cure any physical or mental illness or prescribe medical treatment. During Nutritional Coaching, no acting will be done as a doctor, psychologist, or other registered medical professional. Any recommendation given will not be intended to replace the advice of these professionals. If the User is under the care of a healthcare professional or currently using prescription medications, they should discuss any changes in diet or potential dietary supplements with their specialist physician and should not stop any prescribed medication without consulting their doctor first.
PERSONAL RESPONSIBILITY
The User acknowledges and assumes all responsibility for their life and well-being, as well as the life and well-being of their family, and assumes responsibility for all decisions made during and after the use of “+Balance App x Belu Nutrition Coach”. The User expressly assumes the potential risks of its use, including the risks of trying new foods or supplements, the inherent risks of exercising, and making changes to their lifestyle.
“+Balance App x Belu Nutrition Coach” will not be responsible for any loss or damage resulting from the use of the application, including indirect, special, incidental, or consequential damages.
RELEASE OF HEALTHCARE CLAIMS

ARBITRATION, CHOICE OF LAW, AND LIMITED REMEDIES
All disputes arising out of or in connection with this Plan Agreement will be finally resolved in accordance with the International Chamber of Commerce Arbitration Rules by one or more arbitrators appointed in accordance with such Rules.
MODIFICATION OF TERMS
We reserve the right to modify these Terms and Conditions at any time and at our sole discretion. If we make material modifications to these Terms and Conditions, we will notify you by posting a notice on the application or by sending you an email. Refunds: No refunds are offered once access to the online recipe book has been provided. +Balance App x Belu Nutrition Coach reserves the right to terminate the user’s license to use the application at any time and for any reason, including, without limitation, the breach of the terms and conditions of use. Additionally, +Balance App x Belu Nutrition Coach reserves the right to discontinue the application or any part of it at any time without prior notice.
APPLICABLE LAW AND JURISDICTION
These terms and conditions of use shall be governed and interpreted in accordance with the laws of the United States of America. The user agrees that any dispute arising out of or in connection with these terms and conditions of use shall be subject to the exclusive jurisdiction of the competent courts in Miami, Florida, United States of America.
